Welcome to Tim MacLeod. These Terms of Service ("Terms") govern your access to and use of our websites, digital products, coaching programs, and communication tools, including SMS (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.

1.Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2.Use of Services

You agree to use the Services only for lawful purposes. You must not:

• Violate any applicable local, national, or international law or regulation;
• Infringe upon the intellectual property or other rights of any person or entity;
• Disrupt or interfere with the Services or the networks connected to them;
• Attempt to gain unauthorized access to any portion of the Services.

3.User Accounts

When you create an account, you agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity that occurs under your account, and you agree to notify us immediately of any unauthorized use.

4.Payment Terms

You agree to pay for any products or services purchased using a valid, authorized payment method. Where a payment plan is offered, you agree to complete the plan in full. Missed payments may result in late fees and the suspension or revocation of access. Continued failure to pay may result in permanent termination of access and legal action to recover the outstanding balance.

5.No Refund Policy

All payments made to Tim MacLeod are final and non-refundable under any circumstances. This includes, but is not limited to: change of mind, change of financial or personal circumstances, religious or moral objections, subjective dissatisfaction with the product, or failure to use or access the product after purchase. By completing a purchase and participating in any program, you confirm your understanding and acceptance of this policy. We reserve the right to enforce this policy strictly.

6.Intellectual Property

All content, systems, graphics, trademarks, designs, and videos made available through the Services are the sole property of Tim MacLeod or its licensors. You may not copy, distribute, reproduce, or otherwise exploit any of this material without our express written permission.

7.SMS & Communication Consent

By providing your mobile phone number, you consent to receive SMS and MMS messages from Tim MacLeod, which may include transactional messages, account notifications, and marketing communications. Message frequency may be up to 6 messages per month. You may reply STOP at any time to unsubscribe. Message and data rates may apply. We are not liable for delayed or undelivered messages. Supported carriers include AT&T, Verizon, T-Mobile, and others.

8.Privacy & Data Use

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9.Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or reliability. Results are not guaranteed and will vary based on individual effort, application, and circumstances.

10.Limitation of Liability

To the fullest extent permitted by law, Tim MacLeod shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of income, profits, or data, arising out of or related to your use of the Services.

11.Indemnification

You agree to indemnify, defend, and hold harmless Tim MacLeod and its directors, employees, agents, affiliates, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms or your misuse of the Services.

12.Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for violations of these Terms, non-payment, or any conduct we deem harmful to the Services or other users.

13.Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes shall first be addressed through good-faith mediation, which may be conducted via video conferencing. If mediation fails, disputes shall be resolved through legal proceedings in the Province of Ontario, Canada.

14.Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date.
